GENERAL INFORMATION ABOUT THESE TERMS OF SERVICE
Please read these Terms of Service carefully, as it constitutes a legally binding agreement between you and CrazyGames. We will refer to the Terms of Service as "Terms" in this document from now.
CrazyGames provides a web-based platform on which you can play Games ("Platform").
These Terms describe what you can and cannot do when you use our Platform to play these Games.
When you are using the Platform, you confirm that you have read and accept these Terms. In case you do not agree with these Terms, you are not allowed to use the Platform.
You are also not allowed to use the Platform in the following situations:
A. You are younger than thirteen (13) years old;
B. You are younger than the minimum age which is applicable to the country where you live.
Instead, we have launched a version of the Platform which is more suitable for you and can be found at https://kids.crazygames.com ("Kids Platform"). One of the differences of the Kids Platform is that we will not show you advertisements which are personalized.
In case we discover that you are not old enough to use the Platform, we are allowed to prevent you from accessing the Platform.
PRIVACY
CrazyGames believes it is important to be transparent about how we process your personal data. For more information we refer to our privacy notice which can be found at https://www.crazygames.com/privacy-policy.
1. Terminology
The following definitions are used in the Terms:

| Platform: | The websites and/or other applications which are used by CrazyGames to provide you access with Game(s), including www.crazygames.com. |
| Service(s): | The services which are provided by CrazyGames to you, including but not limited to: (A) The Platform; (B) The Game(s). |
| Terms: | These Terms of Service (including any amendments from time to time). |
| Unsolicited Content: | Has the meaning as described in clause 7.5 of the Terms. |
| Update: | A hotfix, patch or version update or (minor or major) upgrade to the Services. |
| User: | The person to whom CrazyGames grants a right to use the Services under and in accordance with these Terms. Alternatively, the User will be referred to as "you" in these Terms. |
| User Content: | All works and materials (including text and images) that the User submits to the Services or has created based on and/or with the Services. |
| Virtual Currency: | The virtual premium currency that can be bought in the Game(s). |
| Virtual Items: | The virtual items that can be bought in the Game(s). |
2. User License
*Summary: CrazyGames is the owner of the rights to the Platform, but allows you to use the Platform to create an Account and play Games in case you observe the rules in these terms and conditions.*
2.1 CrazyGames hereby grants you a personal, revocable, non-exclusive, non-transferable license to:
A. Create an Account; and
B. Use the Platform to play the Games for your personal enjoyment and non-commercial purposes.
2.2 The license that is granted to you under article 2.1 of these Terms is subject to your compliance with all terms and conditions of these Terms. CrazyGames has the right to suspend and/or terminate your license to the Services in case you do not comply with these terms and conditions.
3. Streaming License
*Summary: CrazyGames allows you to (live)stream and create content when playing the Games on our Platform as long as you comply with our requirements*
3.1 In addition to the license granted in article 2 of these Terms, CrazyGames hereby grants you a personal, revocable, non-exclusive, non-transferable license to:
A. Create and publish content using gameplay and/or screenshots of the Games on the Platform;
B. Publicly display the Platform and the Games on online video streaming and content websites, including but not limited to youtube.com and twitch.com;
3.2 The license as referred to in article 3.1 is subject to the following conditions:
A. The Platform and the logo of CrazyGames will be clearly visible and not obscured;
B. You will only monetize the content in accordance with applicable legislation and the terms and conditions of the platform on which you publish the content and/or stream the Games;
C. You will not infringe any third party rights, including Intellectual Property Rights of a third party;
D. You will not imply or state that you are officially affiliated with, sponsored, endorsed or approved by CrazyGames, except in case CrazyGames has a partnership agreement with you.
3.3 CrazyGames has the right to terminate the license as referred to in article 3.1 of these Terms at any time.
4. Account
Summary: In order to use the platform, you can register an account. When you register, you are not allowed to provide false information. After you receive an account, you are not allowed to give others access to your account. In case someone else gets access, you need to immediately let us know.
4.1 To use the Platform, you are able to register for an Account. To register for an Account, you will need to submit certain information such as a username and a password. Creation and operation of an Account is subject to these Terms.
4.2 You warrant and undertake that all the information you supply during registration for your Account is truthful, complete and correct. You accept and understand that you are obligated to ensure that all information held about you by CrazyGames is up to date. You can notify an update to your registration details at any time by editing the information contained within your Account.
4.3 If CrazyGames is notified or otherwise has reason to believe that the information you have provided is fully or partly inaccurate, incomplete or not up-to-date, CrazyGames has the right to request that you provide updated information without delay. If you fail to provide, correct, update or complete the information as requested, CrazyGames is entitled to block you from using the Platform until you have fully complied with the request.
4.4 Any username and password chosen by or issued to you upon or for registration with CrazyGames is personal to you and should only be used to facilitate your use of and access to the Platform. You agree that you must not disclose your username or password to any third party without CrazyGames's prior written consent.
4.5 If you believe that the security of your username, password or Account may have been compromised, you must inform CrazyGames immediately. CrazyGames is not liable for any damages as a result of your account being compromised.
4.6 You accept and understand that you are solely responsible for all use of the Services undertaken through your Account and by use of your username and password. Do not share your account name or password with any other person or allow any other person to use your account. CrazyGames is not liable for losses or damage resulting from any negligent or improper use of your account name, password, account or any use by any third party that results from failure to comply with these terms.
4.7 You may close your Account with CrazyGames at any time via the Platform. This also terminates the Terms and ends your right to use the Services.
4.8 Without prejudice to other remedies, CrazyGames may immediately restrict, suspend, or terminate your Account and your access to and use of the Services, or any part of them, if:
A. CrazyGames has reasonable cause to believe that you have sold and/or transferred your Account to any third party;
B. CrazyGames has reasonable cause to believe that you are creating problems or possible legal liabilities for, or are infringing the rights of, CrazyGames, any of our Users or third parties;
C. CrazyGames has reasonable cause to believe that such restrictions will improve the security of the CrazyGames community or reduce our or a User's exposure to financial liabilities;
D. CrazyGames has reasonable cause to believe that you are violating these Terms or any policies of CrazyGames; or
E. Despite the reasonable efforts of CrazyGames, it is unable to verify or authenticate any information you provide to us.
4.9 CrazyGames reserves the right to terminate your Account if no activity is conducted by you in relation to the Account for 2 or more years. In such event, no refund will be offered to you for any Virtual Currency and/or Virtual Items in your Account.
4.10 If your Account has been terminated or suspended by CrazyGames, you may no longer use the Services.
5. In-Game Purchases
Summary: CrazyGames does not sell in-game items or offer in-game services to our users. We do, however, facilitate such purchases and services through a third party. When you purchase in-game items or services for a web game, these purchases are linked to your Account with us. We have no control over these in-game items and services and reject any liability with respect to these purchases. Please carefully read the relevant terms and conditions of the third party and their refund policy before you buy any in-game items or services.
CrazyGames provides an in-game ecosystem for Users. The Games are free to play, which means that you are not obliged to pay to be able to play and enjoy the Games. In some Games, it is possible to buy Virtual Currency and/or Virtual Items.
CrazyGames facilitates the purchase of in-game purchases between you and the developer of the web game through the third-party provider Xsolla. You acknowledge that this third-party has its own terms and conditions (https://xsolla.com/eula) and that we are not responsible for these terms. Your in-game purchases will be linked to your Account as well as to your account with the third-party provider.
Please note that in-game purchases and the quality of the game are regulated by the agreement between you and the third party and/or game developers, where applicable. For example, CrazyGames is not responsible for any missing in-game items or any bugs that may occur. Refunds are subject to the refund policy of the third party. 6. Rules of play & conduct
Summary: there are several rules which you have to obey when using the Platform and/or play the Games. This includes rules about your behavior towards others as well as rules regarding operating the Platform and/or the Games. In case you do not comply with these rules, we can restrict your access to the Platform and/or the Games
6.1 Each Game which can be played (as part of the Platform) has its own rules of play, scoring mechanisms and guidelines, which can be found in the game environment. In the event that these elements contain binding rules, these are part of these Terms.
6.2 You will comply with the following obligations when using and/or operating the Services:
A. You will not cheat when using the Services or take unfair advantage of errors and/or bugs;
B. You will not share information and/or content that is misleading or untruthful;
C. You will not share information and/or content that is libelous, defamatory, abusive, harassing, threatening, bullying, racist, discriminatory or hateful;
D. You will not share information and/or content that is erotic and/or pornographic;
E. You will not use our Services to encourage the abuse or exploitation of children in any way possible;
F. You will not share information and/or content that contains hyperlinks, torrents or similar information that includes and/or refers to material that infringes the rights of third parties;
G. You will not share information and/or content that contains commercial, charitable and/or idealistic communication;
H. You will not share information and/or content that contains viruses, malware, trojan horses, worms, bots or other (malicious) software;
I. You will not share information and/or content that contain tools and/or solutions with which the Services can be examined and/or used in an improper way;
J. You will not share information and/or content which infringes the rights, reputation of interests of CrazyGames and/or third parties;
K. You will not share information and/or content which is unlawful;
L. You will not publicly name and/or reveal the identity of any other player;
M. You will not impersonate another person or falsely imply that you are an employee and/or representative of CrazyGames;
N. You will not interfere with or disrupt any server and/or network used to support or provide the Services (including any hacking or cracking into the Services);
O. You will not mask your identity in any way, including, but not limited to, IP masking or accessing the Website through any type of proxy server;
P. You will not interfere with and/or disrupt another player's use of the Services;
Q. You will not negatively affect other users' enjoyment of the Services.
6.3 You will comply with the following obligations when using and/or operating the Services:
A. You will not copy, modify or create derivative works of the Services or any part of it, including data held in memory;
B. You will not modify, remove, or render illegible any copyright notice, digital watermark, proprietary legend or other notice contained on the Platform and/or the Games;
C. You will not distribute, transfer, sublicense, lease, lend, rent, grant a security interest in or otherwise provide access to the Services to any third party;
D. You will not buy, sell or transfer (the contents of) your account of the Services;
E. You will not modify, alter, edit, adapt or create derivative works of the Services;
F. You will not reproduce, decompile and/or reverse engineer the Services, except if this is authorized by mandatory law;
G. You will not conduct any systematic or automated data collection activities (including scraping, data mining, data extraction and data harvesting) for any purpose, including but not limited to training machine learning algorithms or artificial intelligence models;
H. You will not delete, remove, disable or circumvent any security protection measures, anti-cheating measures or proprietary notices in or associated with The Services;
I. You will not use or copy the Platform or the Games, except as expressly permitted in these Terms;
J. You will not use the Platform and/or the Games to generate unsolicited email advertisements or spam;
K. You will not violate any law, rule and/or regulation;
7. User Content & Feedback
Summary: in case you have created User Generated Content within any of the Games, the rights to this content remains yours. However, you need to make sure that the User Generated Content does not violate these terms and conditions or the rights of someone else. So don't recreate something that is owned by someone else. We are allowed to use the User Generated Content for some things, such as marketing.
In case you give us feedback, we are allowed to use that feedback. In that case you cannot claim that you own any rights to the feedback. If you don't want us to do anything with the feedback, then don't give us feedback.
7.1 The Intellectual Property Rights regarding your User Content remains vested in and owned by you. Notwithstanding the foregoing, you grant CrazyGames a worldwide, non-exclusive, royalty-free, transferrable, sub-licensable and irrevocable license to use your User Content for the following purposes:
A. To use it as necessary or useful to provide and maintain the Platform and/or the Games;
B. To use it in any media and channels of distribution now known or developed hereafter, including in connection with marketing and advertising for the Platform and/or the Services.
7.2 You guarantee that the User Content:
A. Complies with these Terms; and
B. Does not infringe any third party right, including Intellectual Property Rights.
7.3 CrazyGames has the right to remove uploaded User Content from its Services at its sole discretion. CrazyGames will use its right if CrazyGames decides that the User Content results in or from a breach of any part of these Terms, or that it may bring CrazyGames or the Services into disrepute (amongst other scenarios). However, you acknowledge that we do not actively monitor User Content that is contributed by people that use our Services and we make no undertaking to do so.
7.4 By accessing and/or playing those of our Games which allow you to play against an opponent or to play socially, you agree to your display name, profile picture (avatar), scores, and other related details being displayed to other users.
7.5 CrazyGames does not accept any unsolicited feedback or ideas, including submissions around concepts, creative ideas, suggestions, stories, scripts, products, games or any other potential creative content (together "Unsolicited Content"). By nonetheless providing us with such, you renounce any possible claim against us and our affiliates with respect to any intellectual property rights vested in such Unsolicited Content, including, but not limited to, copyrights. We will also not compensate you in such instance. Any Unsolicited Content will be disregarded to avoid any possible misunderstanding around intellectual property rights vested in our Services. Receiving your submission of Unsolicited Content will not prevent us from offering, promoting, or developing products, services or games that compete with your Unsolicited Content, or working with others to do so. By submitting any Unsolicited Content to us, you agree to these terms.
7.6 Before, during and after using The Services, you may be invited to provide feedback ("Feedback") to CrazyGames relating to your experience of The Services. You hereby agree that to the extent that you provide any Feedback to CrazyGames or any of its affiliates or to any of their respective employees, agents or contractors, you hereby assign, and agree to assign on a rolling basis, all right, title and interest in and to such Feedback to CrazyGames and you waive all moral rights and similar rights throughout the world in and to such Feedback.
8. Intellectual Property Rights
Summary: the Platform is owned and remains owned by CrazyGames and the Games remain owned by the original owner as well. You are only allowed to do things with the Platform that are described in these terms & conditions
All Intellectual Property Rights to Platform are owned by CrazyGames. The Games are either owned by CrazyGames or its licensors. This Agreement does only provide for a license and does not transfer and/or sell any Intellectual Property Rights to either the Platform or the Games. All rights that are granted to you are expressly mentioned in and are limited by these Terms, which means that no license, permission or right of access shall be implied.
9. Third Party terms
Summary: The Platform contains third party Games, which can be subject to its own terms and conditions. You have to observe these terms and conditions as well. In case these terms conflict with those terms, those terms will prevail for that Game only.
The Games on the Platform can be subject to its own terms and conditions. You acknowledge and agree that you can only play these Games in case you also comply with those terms and conditions. In the event these Terms conflict with those terms and conditions, those terms and conditions will prevail with regards to that specific Game only.
10. Third Party Websites and promotions
Summary: CrazyGames does not control third-party services, and is not liable for any transactions you may perform with them or for what they do. Please be aware that promotions that are made available through the Platform may be subject to additional terms and conditions
Our Website contains links to other websites on the internet. CrazyGames is neither responsible for nor endorses the content, products, services or practices of third-party websites, including, but not limited to, websites embedded in our Website or third-party advertisements, and makes no representations regarding the quality, content, accuracy or suitability of these websites in the context of your viewing or use. Your use of third-party websites is at your own risk and subject to the terms of use of such websites.
IN THE EVENT THAT YOU CHOOSE TO PURCHASE A PRODUCT OR SERVICE FROM A THIRD PARTY, CRAZYGAMES IS NOT RESPONSIBLE FOR SUCH PRODUCTS OR SERVICES, AS IT IS NOT A PARTY TO SUCH A TRANSACTION AND IS NOT LIABLE FOR ANY DIRECT OR INDIRECT COSTS OR DAMAGES ARISING FROM ANY DISPUTE BETWEEN YOU AND SUCH THIRD PARTY. NEITHER CRAZYGAMES, NOR ITS LICENSORS OR CONTRACTORS, MAKE ANY EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING THE GOODS OR SERVICES OFFERED BY SUCH MERCHANT, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT OF CERTAIN RIGHTS OR COMPATIBILITY.
Any sweepstakes, contests, raffles, surveys, games or similar promotions (collectively, "Promotions") made available through the Website may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will govern.
11. Conformity and liability
Summary: it is possible that the platform contains bugs, errors or is not available sometimes. This does not make CrazyGames liable.
In cases where CrazyGames is liable, this is limited to the damage which is a direct result of whatever we did wrong. The amount which we will pay in this case is a maximum of EUR 500, except in situations where the law states that we should be liable for more. Also, we do not exclude any liability for very severe situations, such as death or personal injury
If you have done something wrong and we suffer damages, you will compensate us. In case someone else claims anything from us based on your behaviour, you will cover our costs and damage as well.
11.1 The Services are provided on an "as is" basis without any warranty of any kind. This means that CrazyGames does not guarantee that The Services are free from bugs and/or defects, works flawlessly and/or is available at all times. This also means that there may be times where the Services are not available for technical or (scheduled and/or unscheduled) maintenance related reasons.
11.2 To the maximum extent permitted by applicable law, CrazyGames shall not be liable to you under contract, tort (including negligence) or otherwise for any losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising, directly or indirectly from:
A. Your use or inability to use the Services;
B. Delays or disruptions of the Services;
C. Viruses or other malicious software obtained by accessing, or linking to, the Services;
D. Damage to your hardware from the use of the Services;
E. The content, actions or inactions of third parties;
F. A suspension or other action taken with respect to your use of the Services.
11.3 To the maximum extent permitted by applicable law, you agree that the aggregate liability of CrazyGames to you for all claims arising out of, or relating to the use of, or any inability to use any part of, The Services or otherwise under these Terms, whether under contract, tort, or otherwise, is limited to EUR 500 (five hundred euros).
11.4 Nothing in these Terms shall limit or exclude CrazyGames's liability for fraudulent misrepresentation, death or personal injury resulting from its negligence or the negligence of its agents or employees or for any other liability that cannot be limited or excluded by applicable law.
11.5 You accept sole responsibility for the legality of your actions under the laws applying to you and the legality of any of your User Generated Content.
11.6 You will compensate CrazyGames in full for any losses or costs, including reasonable legal fees, it incurs arising out of any breach by you of these Terms, your improper use of the Services or your infringement of any law or the rights of a third party.
12. Updates & changes to the Platform
Summary: we will update the Platform from time to time. We do not need your consent to do that. We can also update and/or remove Games or take the platform offline if we do not want to offer the platform anymore
12.1 CrazyGames may supply or make available Updates to the Services. You acknowledge that CrazyGames will use technical measures to enforce article 12.1 of these Terms.
12.2 CrazyGames has the right to make a change to the Services or to cease offering a part of the Services at any time, including but not limited to in the following circumstances:
A. In the event of technical reasons;
B. In the event of commercial reasons (when it is no longer commercially feasible to keep offering the Services);
C. In the event of legal reasons;
D. In the event we simply have changed our offering within the Services.
13. Term & termination
Summary: your access to the platform will continue until the terms & conditions are terminated. We can do that at any time. Additionally, we can suspend your access to the platform or terminate your access when it creates (legal) problems for us or when you are violating our rights. We can also do that when we have an assumption you did that.
13.1 These Terms come into force upon your acceptance of thereof and will continue to remain into effect until it is terminated in accordance with the terms and conditions of these Terms.
13.2 CrazyGames may terminate these Terms and your use of The Services at any time.
13.3 Without prejudice to other remedies, CrazyGames may immediately restrict, suspend, or terminate these Terms and thus your access to and use of the Services, or any part of them, in the following cases:
A. CrazyGames has reasonable cause to believe that you are creating problems or possible legal liabilities for, or are infringing the rights of, CrazyGames, any of our Users or third parties;
B. CrazyGames has reasonable cause to believe that such restrictions will improve the security of the Services community or reduce our or a User's exposure to financial liabilities;
C. CrazyGames has reasonable cause to believe that you are violating these Terms or any other applicable rules and/or policies. In the event of violations of the Terms relating to child abuse and/or exploitation, CrazyGames will remove the Content upon becoming aware of such, block the Account and report it to the local authorities;
D. CrazyGames is unable to verify or authenticate any information you have provided after making reasonable efforts to do so.
13.4 If these Terms and/or your use of the Services has been terminated or suspended by CrazyGames, you may no longer use the Services.
14. Changes to these Terms
Summary: we can change the content of these terms and conditions at any time. If you keep using the Platform, you are bound by these new terms. If you do not agree, you can tell us and cancel your account by reaching out to us.
CrazyGames has the right to unilaterally update and/or change the terms and conditions of these Terms. You will be notified in advance of any updated and/or changed terms and conditions of the Terms via the Services and/or the applicable Distribution Platform. Your continued use of the Services after a change of the terms and conditions of these Terms constitutes your acceptance of these terms. In case you do not want to be bound by the amended terms and conditions, you have the right to terminate these Terms via your Account on the Platform or by [email protected].
15. Additional terms
Summary: some very general legal terms, nothing too..... Crazy:
- The terms of this agreement are all terms that are applicable to the platform
- You cannot give this contract or any right to someone else without our permission, we have a contract with you and no one else
- In case there is a term that is not valid, then the rest of the agreements we have made remain effective
- When we contract you, we will do that by e-mail or via the platform. If it is done via some other way, it is probably not us
- Belgian law is applicable to your use of the Platform, except in case the law states that a different legal system is applicable
- In case we ever have a dispute which we need to go to court for, we have to go to the courts in Belgium, except in case the law states we need to go somewhere else.
15.1 These Terms constitute the entire and exclusive understanding and agreement between CrazyGames and you regarding the Services. These Terms supersede and replace any and all prior oral or written understandings or agreements between CrazyGames and you regarding the Services.
15.2 You cannot assign or otherwise transfer these Terms or any right granted or obligation imposed hereunder, except in case you have received prior written consent of CrazyGames for the assignment or transfer. CrazyGames may freely assign or transfer these Terms without restriction, providing that the transfer does not serve to reduce the guarantees benefitting you under these Terms.
15.3 If any term of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that term will be deemed not to form part of these Terms, but the remainder of these Terms shall remain in full force and effect.
15.4 CrazyGames's failure to act with respect to an infringement or breach by you or others does not waive its right to act with respect to subsequent or similar infringements. CrazyGames does not, and cannot, guarantee that it will take action against all infringements or breaches of these Terms.
15.5 Where these Terms specify that CrazyGames shall provide written notice to you, CrazyGames may do so by: (a) sending the notice to any email address supplied or made available by you; or (b) publishing a notice, addressed to users of the Services generally, on its website.
15.6 These Terms shall be governed by and construed under the laws of Belgium, except in the event that mandatory law indicates otherwise.
15.7 Any and all disputes arising from or in connection with these Terms shall be subjected to the exclusive jurisdiction of the court of Leuven.

If you believe in good faith that materials available on the Website or Platform infringe your copyright, you (or your agent) may send us a written notice by courier, mail or e-mail, requesting that we remove such material or block access to it. If you believe in good faith that someone has wrongly filed a notice of copyright infringement against you, you can send us a counter-notice. For US Residents Only: If you are a copyright owner or an agent thereof and believe that your intellectual property rights have been infringed upon, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our copyright agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
